Disney Loses Appeal for $319 million

On Monday the U.S. 9th circuit court of Appeals judges shot down ABC, Buena Vista Television and Valleycrest productions after the three of them claimed to be affiliates of Disney and tried to appeal and earlier order. This is the largest verdict in a profits case in Hollywood history and it will go down in history as the largest thats been upheld on appeal.

This story starts all the way back in 2004 when creators of the show Who Wants to Be A Millionaire  by Celador International, Inc. accused Disney and its affiliates ABC, Buena Vista Television and Valleycrest Production of purposefully setting them up to fail. Celador felt that disney and its affiliates set them up to fail and robbed Celador of millions of dollars in expected revenues by misinforming them. They feel that they were misinformed when Disney failed to include ABC’s profits when calculating the profit participation owed to Celador and had improperly deducted merchandising and other expenses that had to do with the ever so popular tv show.

On July 7 Bloomberg Reported  — Walt Disney Co. was found liable for not paying the U.K. creators of “Who Wants to Be a Millionaire” their share of profits from the quiz show broadcast on Disney’s ABC television network.
