Papa John’s the popular US pizza chain is facing a $250 million class action lawsuit for blasting customers with illegal text messages in order to market themselves. Too bad nobody likes spam..

So basically the plaintiff responsible for the lawsuit is claiming that Papa John’s sent customers a total of 500,000 unwanted messages back in early 2010. As you can guess the text messages that were reported to be spam messages offered customers deals from their pizza menu. Furthermore the complaint state that they were getting about 15 texts in a row all throughout the day sometimes even in the middle of the night. I can understand how Papa John’s could see this as a cool marketing plan, i mean c’mon who doesn’t like pizza right..

But seriously spam text messages daily, that’s a little heavy Papa John.

Papa John’s Faces $250 Million Spam Lawsuit

There is a rule called The Telephone Consumer Protection Act of 1991 which bars companies from sending advertisements via text message without a consumer first opting into the service. As soon as the plaintiffs realized what was going on why not hop on board and file a claim.

Erin Chutich is one of the plaintiffs in the case and he made a statement about the situation. Erin said “After I ordered from Papa John’s, my telephone started beeping with text messages advertising pizza specials, Papa John’s never asked permission to send me text message advertisements.”

According to Caroline Oyler who is Papa John’s head of legal affairs, the corporate text messaging program is not subject to the lawsuit because the messages were being sent by third party vendors and a small number of franchisees. Basically saying don’t blame the corporate company for a few mistakes by our own company. The nationwide class action lawsuit was certified on November 9 by U.S. District Court Judge John Coughenour in Seattle. Oyler added to the madness that Papa John’s plans to appeal the judge’s ruling.

According to sources The pizza franchise sent the texts through a mass text messaging service called OnTime4U. Moreover OnTime4U is also a defendant in the current open case. Papa John’s actually ended their relationship with the mass text messaging service backin April 2010 when they were first sued. It’s funny though because even after being sued in April 2010 company informed its corporate stores and franchisees that sending unsolicited messages to cellphones is illegal. What didn’t they understand.

Oyler added “We don’t agree with it and will continue to aggressively defend it, We’ll continue to litigate the case and defend the lawsuit and move to have it dismissed.”

Good luck Papa John i still think your food isn’t all that bad.

But spam messaging, sorry guys that’s just not cool.
